Disciplinary Actions

Pursuant to Rule 61G15-37.001(11), FEMC is required to post all final orders involving active disciplinary cases to the website until the terms of the final order are completed, or until the licensee becomes inactive, retires, relinquishes the license or permits the license to become null and void. Included in this section are all current active cases in which final action has been taken by the Board, a brief description of the licensee’s violation and discipline as well as a link to the final order.

Case No. 2010029672
Licensee was charged with violating Section 471.0331(d), Florida Statutes. A final order was issued on 06/24/2011, in which Licensee entered into a stipulation authorizing the Board to accept and implement the terms contained in the stipulation. Pursuant to the terms of the Stipulation and Final Order, Licensee is required to fully comply with all terms of his criminal probation. Failure on the part of Licensee to comply with those terms will result in the immediate suspension of his license by FEMC to be followed at the Board’s discretion with Revocation. Licensee agrees that the foregoing penalties may be imposed by FEMC and the Board with no further administrative or judicial action. In addition, the final order imposed fines and costs, successful completion of the professionalism and ethics course and study guide.

Based on a settlement stipulation, the Board imposed a fine of $2,000.00, costs of $618.63, appear, reprimanded, probation of two (2) years, completion of the Laws & Rules study guide, project review at six (6) and eighteen (18) months, and completion of a Engineering Professionalism & Ethics course. Licensee was charged with one (1) count of being negligent in the practice of engineering, 471.033(1)(g), Florida Statutes and one (1) count of final order violation, 471.033(1)(k), Florida Statutes, in Case 2004035804. A final order was issued on 05/13/2011, restricting licensee from practicing any structural engineering until successful completion of the NCEES Civil Engineering Exam with Structural Option, and imposing fines and costs and completion of the intermediate professionalism and ethics course. Once restriction has been lifted licensee will be placed on two (2) years probation with project reviews at six (6) and eighteen (18) months.

Licensee was charged with a second count of violating Section 471.033(1)(a), Florida Statutes, "violating a rule of the Board", by not filing proper notice that he acted as Special Inspector for the Garage Project with the City of Jacksonville, as required by Rule 61G15-35.004(1). The final order was issued on 10/19/2011, imposing a reprimand, fines & costs, study guide, successful completion of the Intermediate professionalism & ethics course; and suspension of license for a term of three (3) years followed by an appearance with the Board to request reinstatement. Licensee was also required to relinquish his certification as a Threshold Special Inspector and has agreed to never reapply in the State of Florida as a Special Inspector.

A final order was issued on August 22, 2011, imposing payment of costs for $117.00 and restriction from practicing structural engineering until successfully passing the NCEES Structural Exam. An appearance before the board is required to have restriction lifted, at which time the Board reserves the right to impose terms of reinstating license.
